79 The Japanese tariff schedule imposed different tariff rates on different kinds of lumber, based on distinctions among various species. These different tariffs had been autonomously introduced by Japan without negotiation. Most of the tariff lines at issue had not been bound by Japan. Canada was of the view that dimension lumber from the species common to Canada was like dimension lumber from other countries, in particular, the United States, and that Canadian lumber was treated less favorably since it was subject to higher duties.

This obligation is unconditional. State B benefits from the advantage whether or not it grants a similar advantage to State A. The second variant-the conditional MFN concept-is different. Where States A and B have entered into an agreement with a conditional MFN obligation, if State A grants an advantage of the type covered by the agreement to State C, then State A must offer the same advantage to State B. However, it is obligated to grant the advantage only if State B fulfills the conditions of the agreement, which would typically require State B to offer to State A a benefit similar to that offered by State C to State A.
